Terms and Conditions for E-Payment

Haj Amount (Advance / Balance) for Haj-2017


1.   E-PAYMENT
1.1

The e-payment facility (Net Banking, IMPS, Credit Card and Debit Card) is being provided to the intending Pilgrims as an optional mode for payment, with transaction charges as per Para No.4 below.

1.2

Haj Amount (Advance / Balance) is chargeable as per the Para -14 of Guidelines for Haj-2017.

1.3

The USER means a person using the facility of e-payment to pay Haj Amount (Advance / Balance).

1.4

The SERVICE PROVIDER means the agency namely Atom Technologies Limited engaged through the Union Bank of India for providing this facility.

1.5

The User must read and agree to these Terms and Conditions before using the e-payment facility. Using the e-payment facility on this website indicates that the User has accepted the terms & conditions. If the User does not accept the terms and conditions he/she should not use this facility.


2.   GENERAL
2.1

For e-payment transactions relating to Haj Amount, Bank Reference Number shall be the identifier.

2.2

Haj Committee of India reserves the right at all times to disclose any information pertaining to the User / transaction as it deems necessary to satisfy any applicable law, regulation, legal process, or Governmental request.

2.3

Haj Committee of India will accept e-payment for the approved banks of the service provider. No card other than those issued in India shall be used for making e-payments.

2.4

When making any e-payment(s), the User will be redirected to the Service Provider’s page who will redirect the User to the other website(s) maintained by third party (ies) (the non-Haj Committee of India website(s)). Haj Committee of India is not responsible for any transactions on the website(s). It shall have no liability for and disclaims all warranties whatsoever, expressed or implied, related to the non-Haj Committee of India website, including, without limitation, any warranties related to performance, security, stability, or non-infringement of the title of the non-Haj Committee of India website(s) and website content or any controls downloaded from the non-Haj Committee of India website.

2.5

The User shall provide details pertaining to KYC, as per the requirement of the Bank / Service Provider.

2.6

The Haj Committee of India may at any time modify the Terms and Conditions at its discretion without any prior notice to the User. Such modified Terms and Conditions shall be applicable with immediate effect.

2.7

The User shall indemnify and hold harmless Haj Committee of India, its Members, Officers, Employees and Service Provider from any claim, demand actions or costs (including lawyer’s fees and legal expenses) arising as a result of any claims made by any third party or any penalty imposed due to, or arising out of breach of these Terms and Conditions, or violations of any laws, rules or regulations or the rights of the third party, by the User.

2.8

Haj Committee of India reserves the right at any time and / or from time to time, without giving or being required to give any reason or prior notice modify or discontinue, temporarily or permanently, the access to this facility and remove and discard the contents.


3.   TRANSACTIONS & REFUND
3.1

A transaction can be considered to be successful only after generation of receipt.

3.2

The payment towards the successful transaction will normally be credited to Haj Committee of India’s account in two working days.

3.3

In case, the receipt is not generated and User’s account is also not debited, the user shall have to reinitiate the payment.

3.4

In case, the receipt is not generated and the user’s account is debited, the user should inform the Haj Committee of India through e-mail account.hci@gov.in , compcell.hci@gov.in with the details mentioned below :-

a.

Cover number.

b.

Bank reference number.

c.

Amount.

d.

Transaction date & number.

Haj Committee of India shall verify whether the amount is credited to its account :-

i.

i. If the account is found to have been credited then a receipt will be generated and mailed to the User.

ii.

If the amount is found not to have been credited to its account, the user shall be asked to reinitiate the payment.

3.5

If any user makes excess payment, refund of the excess amount actually received by Haj Committee of India (excluding Online Gateway transaction charges) only, shall be made after due verification, on receipt of the claim from the user.

3.6

In all other cases, refund will be made as per Para No.26 of the Guidelines for Haj-2017.


4.   TRANSACTION CHARGES

The following transaction charges shall be payable by the User for availing this e-payment facility:

PAYMENT OPTION TRANSACTION CHARGES
Debit Card (for transaction below Rs.1,000/-) 0.25% per transaction
Debit Card (for transaction between Rs.1,000/- to Rs.2,000/- ) 0.50% per transaction
Debit Card (for transaction above Rs.2,000/-) 1.00% per transaction
Credit Card 1.10% per transaction
Net Banking / IMPS Flat Rs.10/- per transaction
Note : Applicable Taxes Extra

5.   LIMITATION OF LIABILITY
5.1

Haj Committee of India shall not be responsible or liable at any time for any loss / damage caused by reason such as any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on this section of website.

5.2

In any case, liability of Haj Committee of India to the User in all events under any applicable law whatsoever for all loss or damage arising out of use of this facility shall be limited to the value of the amount the User had paid to Haj Committee of India by use of this facility.


7.   JURISDICTION

Any dispute arising out of use of this facility will be governed by the laws of India and subject to the jurisdiction of the Courts at Mumbai.
